Improve Art Inc. operates improveart.com and provides commercial photography and video services. This policy explains what personal information we collect, why we collect it, how we use and store it, and what choices you have.
In this policy, “we”, “us”, and “our” refer to Improve Art Inc.
Section 1 – Information We Collect
When you visit this website. We automatically receive technical information including your IP address, browser type, operating system, referring page, and the pages you view. This is used to understand how the site is used and to keep it secure.
When you contact us. If you use the contact form, email us, or call, we collect the information you provide. This usually includes your name, email address, phone number, business name, and the details of your enquiry.
When you become a client. We collect the information needed to plan and deliver the work. This may include your business address, shoot location, billing details, the names and contact details of people involved in the shoot, and any files or briefs you send us.
Payment information. We do not store credit card numbers. Payments are processed by third-party providers who handle card details under their own privacy policies.
Email updates. If you opt in, we collect your email address to send occasional updates about our work and services. You can unsubscribe at any time.
Section 2 – Photographs and Video of People
Photographs and video that identify a person are personal information. Because this is the core of what we do, we set out our practice separately.
Consent. We photograph and film people with their consent, or with the consent of the business engaging us for the shoot. Where the intended use requires it, we obtain a written model release or property release before or at the time of the shoot.
Purpose. Images and video are produced for the purpose agreed with the client for that project. The scope of use is set out in the quote, booking confirmation, or written agreement for that project.
Portfolio and promotional use. We may show work produced for a client on this website, on social media, and in proposals, unless the project agreement says otherwise. If you appear in an image or video on this site and want it removed, email us and we will remove it from our own channels. We cannot remove copies published by the client or by third parties.
Storage. Files are stored on encrypted computers and in business cloud storage accounts. Access is limited to Improve Art Inc.
Minors. Anyone under the age of majority is photographed only with the consent of a parent or guardian, who must be present or have given written permission.
Section 3 – How Long We Keep Files
We do not guarantee retention. We may keep files for as long as we consider necessary, and we may remove them at any time after a project has been delivered. Do not rely on us as your only copy. Keep your own backup of every file we send you.
We do not guarantee that source material is archived. Camera originals, unused frames, unused footage, separate audio, project timelines, and editable working files may not be kept after a project is delivered. Do not assume the source material for your project still exists.
The delivered file is the deliverable. For video this is normally the finished MP4. For photography it is the finished image file. These are final rendered files. They are not editable source projects.
Re-edits. If you need a delivered video changed later, for example to update a logo, brand, contact details, office address, or price, the original editable material may no longer be available. Ask us before planning around a re-edit. Where the source material is no longer held, the change is quoted as a new project rather than as a revision.
If long-term retention of source material matters to you, tell us before the shoot so it can be arranged and quoted.
Section 4 – How We Use Information
We use personal information to:
- respond to enquiries and provide quotes
- plan, schedule, and deliver photography and video work
- issue invoices and keep the financial records required by law
- deliver files and handle revision requests
- maintain and improve this website
- send email updates, where you have opted in
- show examples of our work, as described in Section 2
We do not sell personal information. We do not share it for third-party advertising.
Section 5 – Consent
When you give us personal information to make an enquiry or complete a booking, you consent to us collecting and using it for that purpose.
If we want to use your information for a different purpose, such as marketing, we will ask for your consent or give you a clear way to decline.
You can withdraw your consent at any time by emailing booking@improveart.com. Withdrawal does not affect processing that already took place, and it does not override a licence already granted to a client for images produced under a project agreement.
Section 6 – Cookies and Analytics
A cookie is a small text file placed in your browser. This website uses cookies for basic site function and for analytics.
We use analytics to understand how many people visit the site and which pages they read. Analytics data is aggregated and is not used to identify individual visitors.
Embedded video players and social media embeds may set their own cookies when you interact with them.
You can block or delete cookies in your browser settings. Some parts of the site may not work correctly if you do.
Section 7 – Third-Party Services
We use third-party providers to run the business. They only receive the information needed to perform their service for us.
File delivery. Finished files are delivered through Google Drive or Dropbox, and occasionally by other file transfer services or physical media.
Video hosting. Video shown on this website or shared with clients may be hosted or streamed through Cloudflare Stream, YouTube, or similar services.
Other providers. We also use third parties for website hosting and security, website analytics, email and calendar, payment processing, and accounting.
Each of these providers handles information under its own privacy policy. Some store or process information outside Canada, including in the United States and the European Union. Information held in another country may be accessible to the courts, law enforcement, and authorities of that country.
Once you leave this website or are redirected to a third-party site, this policy no longer applies. We are not responsible for the privacy practices of other websites, and we encourage you to read their policies.
Section 8 – Disclosure
We disclose personal information only when:
- you have consented
- it is necessary to complete work you have engaged us for
- a service provider needs it to perform a service for us
- we are required to do so by law, subpoena, or court order
- it is necessary to enforce our Terms of Use or to protect our legal rights
If the business is sold or merged, client and enquiry records may transfer to the new owner as part of that transaction. The information would remain subject to a policy no less protective than this one.
Section 9 – Security
We use reasonable safeguards to protect personal information, including encrypted devices, access-controlled cloud storage, strong authentication on business accounts, and a secure connection on this website.
No method of transmission or storage is completely secure. We cannot guarantee absolute security. If a breach occurs that creates a real risk of significant harm, we will notify the individuals affected.
Section 10 – Your Rights
You may:
- ask what personal information we hold about you
- ask for a copy of it
- ask us to correct information that is inaccurate or incomplete
- ask us to delete information, subject to legal and contractual limits
- withdraw consent for marketing emails
- ask us to remove your image from our website and social media
Email booking@improveart.com and we will respond within 30 days. We may need to verify your identity before acting on a request.
Section 11 – Age
By using this website you confirm that you are the age of majority in your province or territory of residence, or that a parent or guardian has consented to your use of the site.
Section 12 – Changes to This Policy
We may update this policy. Changes take effect when posted on this page, and the date at the top is updated. If we make a material change to how we handle personal information, we will note it here.
