The material on this site is provided for general information only. We are not responsible if information on this site is not accurate, complete, or current. It should not be relied on as the sole basis for making decisions without consulting more accurate, more complete, or more timely sources. Any reliance on material on this site is at your own risk.

Section 3 – Portfolio, Client Work, and Third-Party Brands

The images and videos on this site are examples of work produced by Improve Art Inc. Many were made for clients and show their products, packaging, premises, staff, or branding.

Third-party names, logos, packaging, and products appear on this site to identify the work we performed. They remain the property of their respective owners. Their appearance does not mean the owner endorses, sponsors, or is affiliated with Improve Art Inc., and it does not indicate a current business relationship.

Portfolio work is a record of a project at the time it was produced. Some projects are many years old. We make no representation that a business shown is still operating, that its products, services, prices, locations, or claims are still offered, or that any information visible in an image or video is current or accurate. Text, labels, signage, menus, and on-screen claims appearing within a photograph or video are statements of the client, not of Improve Art Inc.

People shown in images appeared with permission for the use made at the time of the shoot. Their appearance is not an endorsement of Improve Art Inc. or of any product or service.

If you hold rights in anything shown on this site and want it removed or corrected, email booking@improveart.com with the page address and a description of the material. We will review and respond.


Section 4 – Intellectual Property

All content on this website, including photographs, video, audio, graphics, text, layout, and code, is protected by copyright and is owned by Improve Art Inc. or used with permission. No part of this website may be copied, reproduced, republished, or distributed in any form without our written consent.

The Improve Art logo is a registered trademark of Improve Art Inc.

All other product names, logos, brands, trademarks, and commercials appearing on this site are the property of their respective owners, and are used as described in Section 3.


Section 5 – Photography and Video Services

These Terms govern use of this website only.

Photography and video services are governed by the separate quote, booking confirmation, invoice, or written agreement issued for that project. That document sets out the scope of work, usage rights, licensing, delivery, and payment terms for the images and video produced.

Nothing on this website grants a licence to use any image or video, and nothing on this website replaces or overrides the terms of a project agreement.

File retention and source material. We may keep project files for as long as we consider necessary, and we may remove them at any time after delivery. We do not guarantee that any file is retained, and we do not guarantee that source material is archived. Camera originals, unused frames, unused footage, separate audio, project timelines, and editable working files may not be kept after a project is delivered. The delivered file is the deliverable. It is a final rendered file, not an editable source project. Where source material is no longer held, a later change to a delivered file, such as updating a logo, brand, contact details, address, or price, is quoted as a new project rather than as a revision. Clients are responsible for keeping their own copy of every delivered file.

Prices, packages, and service descriptions shown on this site are subject to change without notice. A price becomes binding only when confirmed in writing for a specific project.


Section 6 – Third-Party Links and Tools

Links on this site may direct you to third-party websites that are not affiliated with us. We do not examine or evaluate their content and we do not warrant, and will not have any liability for, any third-party materials, websites, products, or services.

We may provide access to third-party tools that we neither monitor nor control. These are provided on an “as is” and “as available” basis, without warranties, representations, conditions, or endorsement of any kind. Your use of them is at your own risk. You should review the terms of the relevant third-party provider before use.

Complaints, claims, or questions about third-party products or services should be directed to that third party.


Section 7 – Submissions and Feedback

If you send us creative ideas, suggestions, proposals, plans, comments, or other materials, whether requested or not, you agree that we may edit, copy, publish, distribute, translate, and otherwise use them in any medium without restriction. We are under no obligation to keep any submission confidential, to pay compensation for it, or to respond to it.

You agree that your submissions will not violate any right of any third party, including copyright, trademark, privacy, personality, or other proprietary rights, and will not contain unlawful, defamatory, abusive, or obscene material, or any virus or malicious code. You may not use a false email address or misrepresent who you are.

We may, but are not obligated to, monitor, edit, or remove any submission we determine in our sole discretion to be unlawful, offensive, or in violation of these Terms.

You are solely responsible for any submission you make and for its accuracy.


Section 8 – Personal Information

Your submission of personal information through this site is governed by our Privacy Policy.


Section 9 – Prohibited Uses

You are prohibited from using this site or its content:

  • to infringe our intellectual property rights or those of others

In no case shall Improve Art Inc., its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of this site or any content on it, even if advised of the possibility of such damages.

Where a jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.


Section 11 – Indemnification

You agree to indemnify, defend, and hold harmless Improve Art Inc. and its officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms, or your violation of any law or the rights of a third party.


Section 12 – Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision is still enforceable to the fullest extent permitted by applicable law, and the unenforceable portion is severed from these Terms. This does not affect the validity or enforceability of the remaining provisions.


Section 13 – Termination

Obligations and liabilities incurred before the termination date survive the termination of this agreement for all purposes.

If we determine, or reasonably suspect, that you have failed to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and may deny you access to the site or any part of it.


Section 14 – Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this site, constitute the entire agreement between you and us regarding your use of this website, and supersede any prior agreements, communications, and proposals, whether oral or written, including any prior version of these Terms.

Any ambiguity in the interpretation of these Terms will not be construed against the drafting party.


Section 15 – Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario.
